The Seventh Circuit U.S. Court of Appeals has granted an unopposed motion in favor of the firm’s client, vacating the district court’s sentence and remanding for resentencing due to the misapplication of the statutory mandatory minimum.  After the firm discovered that the client’s prior, state-court conviction was void, and therefore did not qualify to enhance his federal sentence, the government conceded that the client was entitled to a resentencing under the correct mandatory minimum.  The Court of Appeals agreed.

Vanessa Eisenmann and Michelle Jacobs represented the defendant on appeal. The firm now has 13 criminal-defense victories in the Seventh Circuit since opening in 2013.
