The Seventh Circuit Court of Appeals has ruled in favor of the firm’s client, vacating his sentence and remanding for resentencing due to the misapplication of the firearms-trafficking enhancement. The Court of Appeals concluded that, in applying the enhancement without sufficient evidence from the government, the district court had engaged in impermissible speculation.
Michelle Jacobs and Vanessa Eisenmann represented the defendant on appeal, and Jacobs presented oral argument. The firm now has 12 criminal-defense victories in the Seventh Circuit since opening in 2013.
